Terms governing access to and use of the CobraAI service.

1. Agreement to these Terms

These Terms of Service govern your access to and use of CobraAI, including its website, applications, AI features, accounts, paid plans, file features, and related services.

By creating an account, accessing CobraAI, purchasing a paid service, or otherwise using CobraAI, you agree to these Terms, the Privacy Policy, the Acceptable Use Policy, and any additional terms presented for a particular feature.

If you do not agree to these Terms, do not use CobraAI.

2. Eligibility

You must be at least 13 years old to use CobraAI.

If you are under the age of legal majority where you live, you may use CobraAI only with the permission of a parent or legal guardian where that permission is required by law. A parent or legal guardian should review paid purchases made by a minor.

If you use CobraAI on behalf of an organization, you represent that you have authority to accept these Terms on its behalf.

3. Accounts

  • You must provide accurate account information when required.
  • You are responsible for maintaining the security of your account and authentication credentials.
  • You may not access another person's account without authorization.
  • You must promptly take reasonable steps to secure your account if you believe it has been compromised.
  • CobraAI may limit, suspend, or terminate accounts that violate these Terms or create security, legal, payment, or abuse risks.

4. The CobraAI service

CobraAI provides AI-assisted chat, reasoning, coding assistance, file analysis, image generation, image and document understanding, and other features that may change over time.

CobraAI may use different third-party AI models and providers depending on the selected model profile, request type, feature availability, service reliability, pricing, safety requirements, or future product changes.

Features, models, limits, provider routing, and availability may be added, changed, restricted, replaced, or removed.

5. User Content

User Content includes prompts, messages, uploaded files, images, documents, feedback, and other material you provide to CobraAI.

As between you and CobraAI, CobraAI does not claim ownership of User Content merely because you submit it to the service.

You grant CobraAI a limited, worldwide license to host, store, reproduce, transmit, process, and otherwise use User Content as reasonably necessary to provide, secure, maintain, troubleshoot, and legally operate the service. This includes transmitting relevant User Content to service providers and AI providers used to complete your request.

You represent that you have the rights and permissions necessary to submit User Content and to allow CobraAI to process it as described in these Terms and the Privacy Policy.

6. Sensitive information

CobraAI is not intended to be a secure repository for highly sensitive personal information. Do not submit passwords, authentication secrets, full payment-card information, government identification numbers, private keys, or other information that does not need to be included in an AI request.

You are responsible for deciding whether information is appropriate to submit to an AI service.

7. AI Outputs

AI-generated outputs may be incorrect, incomplete, outdated, misleading, non-unique, or unsuitable for a particular purpose.

You are responsible for reviewing and verifying important outputs before relying on them.

CobraAI is not a substitute for a qualified professional when professional medical, legal, financial, engineering, safety, or other specialized advice is required.

Similar or identical outputs may be generated for different users. Rights in AI-generated material may vary depending on applicable law, the underlying material, and third-party rights.

8. Free and paid plans

CobraAI may offer free and paid plans with different request limits, model access, file limits, usage balances, or other features.

Free-plan limits may reset on a recurring schedule and may be changed as the service evolves.

CobraAI Pro and extra AI usage purchases are also governed by the Billing & Refund Policy.

9. Subscriptions and recurring billing

CobraAI Pro is a recurring subscription. Unless canceled, the subscription renews automatically for successive billing periods and the applicable subscription price is charged through Dodo Payments.

CobraAI supplies and operates the CobraAI service. Dodo Payments acts as Merchant of Record for paid transactions completed through Dodo Payments checkout.

By completing Dodo Payments checkout, you authorize the recurring or one-time charge shown at checkout and agree to the applicable Dodo Payments buyer and transaction terms presented there.

Applicable taxes may be calculated, collected, and remitted by Dodo Payments where required for the transaction and under applicable law.

10. Cancellation

You may cancel CobraAI Pro through CobraAI Subscription Management and the Dodo Payments Customer Portal made available by CobraAI.

Unless otherwise stated or required by law, a cancellation scheduled for the end of the current billing period allows Pro access to continue until that paid period ends.

Scheduling cancellation may immediately disable eligibility to purchase additional extra AI usage even while other Pro access continues through the end of the paid period.

11. Refunds

CobraAI does not promise refunds merely because a user changes their mind, cancels a subscription, leaves subscription time unused, or leaves AI usage unused.

Dodo Payments processes paid transactions as Merchant of Record. Refund handling is subject to this Policy, the applicable Dodo Payments terms, and mandatory consumer rights that apply to a purchase.

Nothing in CobraAI's policies limits any mandatory consumer right that cannot legally be waived.

If a payment associated with a subscription or usage balance is refunded, reversed, disputed, or charged back, CobraAI may remove access or adjust balances associated with that payment.

12. Acceptable Use

You must comply with CobraAI's Acceptable Use Policy. You may not use CobraAI to violate applicable law, harm other people, compromise systems without authorization, defraud others, violate intellectual-property rights, or interfere with the operation or security of the service.

13. Third-party services

CobraAI relies on third-party services for functions such as authentication, database and file storage, hosting, payment and transaction services, and AI inference.

Those third parties may process information under their own applicable agreements and privacy practices. CobraAI is not responsible for independent third-party services that are outside CobraAI's control.

14. Open-source software

Certain CobraAI source code may be released under an open-source license. The license governing released source code is separate from these Terms.

These Terms govern use of the hosted CobraAI service. They do not replace any open-source license that expressly governs separately distributed source code.

15. Suspension and termination

CobraAI may restrict or suspend access when reasonably necessary to address security threats, fraud, nonpayment, abuse, legal requirements, violations of these Terms, or significant risk to CobraAI, users, providers, or third parties.

CobraAI may terminate accounts for serious or repeated violations. Where appropriate and legally permitted, reasonable notice may be provided.

Deleting or terminating an account may result in loss of stored chats, files, generated images, settings, and unused usage balances, except where applicable law requires otherwise.

16. Service availability

CobraAI is provided on an as-available basis. AI providers, payment services, hosting services, internet infrastructure, and other dependencies can experience outages or changes.

CobraAI does not guarantee uninterrupted availability, particular model availability, error-free outputs, or preservation of every feature indefinitely.

17. Disclaimer of warranties

To the maximum extent permitted by applicable law, CobraAI is provided without warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms limits warranties or consumer rights that cannot legally be excluded.

18. Limitation of liability

To the maximum extent permitted by applicable law, CobraAI will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the service.

To the maximum extent permitted by applicable law, CobraAI's aggregate liability arising from the service will not exceed the amount attributable to the CobraAI products you purchased during the three months preceding the event giving rise to the claim.

These limitations do not apply where applicable law does not permit the relevant limitation or exclusion.

19. Changes to these Terms

CobraAI may update these Terms as the service, law, providers, or business changes. The updated Terms will identify a new effective or last-updated date.

Where applicable law requires additional notice or consent for a material change, CobraAI will provide it.
